These terms and conditions apply to the BlasterScribe app (hereby referred to as "Application") for mobile devices that was created by Ji R. (hereby referred to as "Service Provider") as a Freemium service.
Upon downloading or utilizing the Application, you are automatically agreeing to the following terms and our Privacy Policy. It is strongly advised that you thoroughly read and understand both documents prior to using the Application.
The Application is intended for users who are at least 13 years of age. By using the Application, you represent and warrant that you are at least 13 years old. If you are under 13 years of age, you are not permitted to use the Application.
Unauthorized copying, modification of the Application, any part of the Application, or our trademarks is strictly prohibited. Any attempts to extract the source code of the Application, translate the Application into other languages, or create derivative versions are not permitted. All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider.
The Application is currently offered as a free service. The Service Provider is dedicated to ensuring that the Application is as beneficial and efficient as possible. As such, they reserve the right to modify the Application, add premium features, or charge for certain services at any time and for any reason. The Service Provider assures you that any charges for the Application or its services will be clearly communicated to you in advance. Your continued use of the Application after such changes constitutes acceptance of the new terms.
The Application allows you to create, upload, and store content including but not limited to images, blaster specifications, performance data, and other information (hereby referred to as "User Content"). You retain all ownership rights to your User Content. By uploading or creating User Content through the Application, you grant the Service Provider a worldwide, non-exclusive, royalty-free license to store, display, and process your User Content solely for the purpose of operating and providing the Application's services to you. You represent and warrant that you own or have the necessary rights to all User Content you upload and that such content does not violate any third-party rights or applicable laws.
The Application stores and processes personal data that you have provided to the Service Provider in order to provide the Service. It is your responsibility to maintain the security of your phone and access to the Application. The Service Provider strongly advises against jailbreaking or rooting your phone, which involves removing software restrictions and limitations imposed by the official operating system of your device. Such actions could expose your phone to malware, viruses, malicious programs, compromise your phone's security features, and may result in the Application not functioning correctly or at all.
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, store, and protect your information. The Privacy Policy explains what data we collect, how it is used, your rights regarding your data, and how you can manage your information. By using the Application, you agree to the terms of our Privacy Policy.
The Application utilizes third-party services to provide functionality. These third-party service providers include:
These third-party services have their own terms and conditions and privacy policies. The Service Provider is not responsible for the practices of these third-party services. You acknowledge and agree that the Service Provider is not liable for any damage or loss caused by your use of these third-party services.
Please be aware that the Service Provider does not assume responsibility for certain aspects. Some functions of the Application require an active internet connection, which can be Wi-Fi or provided by your mobile network provider. The Service Provider cannot be held responsible if the Application does not function at full capacity due to lack of access to Wi-Fi or if you have exhausted your data allowance.
If you are using the Application outside of a Wi-Fi area, please be aware that your mobile network provider's agreement terms still apply. Consequently, you may incur charges from your mobile provider for data usage during the connection to the Application, or other third-party charges. By using the Application, you accept responsibility for any such charges, including roaming data charges if you use the Application outside of your home territory (i.e., region or country) without disabling data roaming. If you are not the bill payer for the device on which you are using the Application, they assume that you have obtained permission from the bill payer.
Similarly, the Service Provider cannot always assume responsibility for your usage of the Application. For instance, it is your responsibility to ensure that your device remains charged. If your device runs out of battery and you are unable to access the Service, the Service Provider cannot be held responsible.
In terms of the Service Provider's responsibility for your use of the Application, it is important to note that while they strive to ensure that it is updated and accurate at all times, they do rely on third parties to provide information to them so that they can make it available to you. The Service Provider accepts no liability for any loss, direct or indirect, that you experience as a result of relying entirely on this functionality of the Application.
The Application is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. The Service Provider does not warrant that the Application will be uninterrupted, error-free, secure, or free from viruses or other harmful components. You use the Application at your own risk.
To the maximum extent permitted by law, the Service Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from: (a) your use or inability to use the Application; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the Application; (d) any bugs, viruses, or other harmful code that may be transmitted to or through the Application; or (e) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Application.
The Service Provider may wish to update the Application at some point. The Application is currently available as per the requirements for the operating system (and for any additional systems they decide to extend the availability of the Application to) may change, and you will need to download the updates if you want to continue using the Application. The Service Provider does not guarantee that it will always update the Application so that it is relevant to you and/or compatible with the particular operating system version installed on your device. However, you agree to always accept updates to the Application when offered to you. The Service Provider may also wish to cease providing the Application and may terminate its use at any time without providing termination notice to you. Unless they inform you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must cease using the Application, and (if necessary) delete it from your device.
You may delete your account and associated data at any time through your profile settings in the Application, or by contacting the Service Provider at blasterscribe@gmail.com. Upon deletion, the Service Provider will delete your account and associated personal data within 30 days, subject to any legal obligations to retain certain information. Please note that some data may persist in backup systems for a limited period following deletion.
The Service Provider may periodically update these Terms and Conditions. When changes are made, the Service Provider will update this page with the new Terms and Conditions and revise the effective date. For material changes, the Service Provider may notify you via email or through an in-app notification. You are advised to review these Terms and Conditions regularly. Your continued use of the Application after any changes constitutes acceptance of the updated terms.
